3-Day Cure Sheet

The following is a guideline as to when a Cure Period Notice would be deemed applicable, when using the 2011 AAR Residential Resale Purchase Contract.

1f	27-29	Should any addenda noted not be received at time of contract.
1g	40-45, 48	Should items not be same as noted on signed contract at COE.
2d	62-65	Should executed LSR not be attached at time of submitting offer to Seller for acceptance.
2f	69-71	Should loan documents not be signed by Buyer 3 days prior to COE.
4a	134-136	Should Seller not provide to Buyer within 5 days after contract acceptance.
4b	137-141	Should Seller not provide to Buyer within 5 days after contract acceptance.
4d	158-161	Should Seller not provide to Buyer within 5 days after contract acceptance.
6i	232-235	Written notice of items disapproved to Seller after expiration of Inspection Period.
6j	236-254	Item 2b-Seller has agreed to correct items but has failed to completely furnish receipts per contract.
6k	255-257	Written notice using BINSR form.

Calculating Time Periods

Section 8h, Line 353-354 & Section 8i, Lines 355-359 provide Cure Period calculation to be a 24 hour calendar day and the date of delivery notice does not count as the first day. The clock starts 12:01 a.m. next day after delivery. The last day of the period is included and ends at 11:59 p.m.

* Date that Signed Cure Period Notice is delivered to breaching party.

If COE falls on a day when the Title Company and/or Recorder's Office is Closed, COE will be on the next day both are open.

If breaching party does not cure breach within 3 days, Pioneer Title would then require a written instruction the following day from the non-breaching party to cancel the contract.
